INVITATION TO TENDER FOR THE PROVISION OF SERVICES RELATED TO FOUNDATION MEDIATION TRAINING PURSUANT TO LAW 3898/2010 AND PRESIDENTIAL DECREE 123/2011, AS WELL AS MEDIATION ADVOCACY TRAINING

The Mediation Training Institute of Thessaloniki within the framework of its programmes on foundation mediation training and mediation advocacy training, for the period from 1 January 2017 to 31 December 2018, pursuant to the relevant decision made by the Governing Board,

INVITES

national or foreign natural persons or legal entities or associations of natural persons engaged in the foregoing subject matters to submit their tenders for the provision of training programmes and services, according to the following information and under the terms and conditions listed below:

1. OBJECT OF TRAININGS

  • Foundation training in mediation, according to the provisions of L. 3898/2010 and PD 123/2011.
  • Advanced training in family mediation.
  • Advanced training in mediation in workplace disputes.
  • Mediation advocacy training, in all stages of the preparation for the mediation and the actual mediation process, including negotiations.

2. TERMS-CONDITIONS OF PARTICIPATION

All tenderers must meet in any case all terms and conditions herein:

  • The duration of the contract with the Provider will be initially two years with the option to extend the contract for up to a further two years.
  • They must have prepared/developed a training programme themselves and be owners of the submitted programme.
  • Mediator trainers must have the qualifications required under article 5, PD 123/2011.
  • They must not be engaged in any form or type of collaboration with any other domestic, foreign or international mediation training organisation doing business in Greece and they must state so via a solemn declaration under L. 1599/1986.
  • The foundation training must be provided in both Greek and English.
  • The foundation training must be provided in accordance with the provisions of PD 123/2011 and its duration should be at least forty (40) hours, the advanced trainings at least twenty-four (24) hours, and the mediation advocacy trainings up to twenty-four (24) hours.

3. CONTENT OF TENDERS – SUBMISSION PROCEDURE AND DEADLINE

3.A. The tender files to be submitted must necessarily include the following documents:

  1. Copy of Identity Card or Passport and, in case of legal entities, the current Articles of Incorporation and the Greek Government Gazette issues where the Articles of Incorporation and/or any amendments thereto have been published (for Societes Anonymes and Limited Liability Companies), the current Articles of Incorporation and any amendments thereto (for General and Limited Partnerships), information and documents which state the names of the Chairman and Chief Executive Officer of the S.A. or Ltd. companies, any other individuals who may bind the legal entity with their signature, as well as their authorisation documents, if this information cannot be directly found in the Articles of Incorporation, depending on the legal form of the companies or any other legal entity.
  2. The mediator accreditation diploma of the individual tenderer and/or the persons who will be mediator trainers from the bidding legal entities.
  3. Supporting documents proving that the conditions of article 5 of PD 123/2011 ("mediator trainer") are met.
  4. Detailed description of the syllabus, with reference to its duration, distribution per day, hours, days, the trainer or trainers and their participation in the programme.
  5. Financial tender, signed by the natural person or the legal representative of the legal entity, with and without any relevant VAT. The financial tender must include any cost/amount related to and necessary for the implementation of the programme, including but not limited to staff, training material, translation, interpreting, catering services, etc. whose cost shall be fully borne by the tenderer.
  6. The potential provider should state the fee to be charged to the delegates including justification for the fee charged and the fee that should be deducted to the Institute.

Documents under 3.A.1. and 3.A.3. will be submitted separately for each and all trainers included in the tender.

All documents listed herein shall be submitted as follows:

Greek documents: originals or legally certified copies;

foreign documents: originals or legally certified documents, according to the relevant country's laws, translated into English or Greek and vice versa. 

3.B. Tenders shall be submitted in a sealed envelope, which shall necessarily bear the tenderer’s name and contact details (address, telephone number, fax, e-mail).

Those wishing to submit a tender, according to the requirements herein, shall submit the sealed envelope or envelopes by Monday, 5th December 2016, to the offices of the Bar Association of Thessaloniki, office 8, Hellenic Courts, Thessaloniki, 4th floor, 09.00 - 14.00 P.C. 54626.

Any tenders which do not meet the terms and conditions herein or miss the deadline shall be rejected as inadmissible.

4. VENUE

The services shall be provided at the premises of the Mediation Training Institute of Thessaloniki in Thessaloniki.

5. SELECTION OF TENDERS - SIGNING OF THE CONTRACT - PAYMENT

The tenders opened and examined as to the fulfillment of the formal and substantial conditions under this invitation are then considered by the Governing Board of the Mediation Training Institute of Thessaloniki, which will decide on the selection and acceptance of a tender.

The selection will be made based on financial and merit-based criteria, more specifically by considering the particular information included in the submitted tenders.

After the decision to accept the tender has been notified, the successful tenderer is invited to sign the relevant contract, submitting all authorisation documents or any other supporting documents requested.  

The payment for the services provided shall be made in the way and at the time set in the contract that will be signed.
